According to a court document, Elon Musk has subpoenaed his friend and former Twitter boss Jack Dorsey as he tries to back out of his $44 billion deal to buy the social media company.

The Tesla boss – the richest man in the world – announced his plan buy twitter in april, but is now fight not to buy it.

Mr Musk and Twitter are heading for a court showdown on October 17, which is expected to determine whether Twitter can force the billionaire to buy.

This month the SpaceX Founders sold its $6.9bn (£5.7bn) Tesla shares. while his tussle with Twitter continues.

Mr Musk has claimed Twitter failed to provide adequate information on the number of fake or “spam bot” Twitter accounts and breached its obligations under the deal by firing top executives and laying off a significant number of employees.

Musk’s team expects more information about the bot numbers to be revealed during the preliminary hearing of the court case when both sides are required to present evidence.

Twitter argues that Mr Musk’s reasons for withdrawing are just a cover for the buyer’s remorse.

The subpoena to Mr. Dorsey was served last week, asking him to receive documents and notices related to the acquisition, as well as information about the impact of fake or spam accounts on Twitter’s business and daily active user measurement.
